Splošni pogoji programa “Tezenis Talent”.
Program zvestobe “TEZENIS TALENT” (v nadaljevanju »Program zvestobe«) je program, ki ga izvaja podjetje Verudela d.o.o. (v nadaljevanju družba) s sedežem Anžurjeva ulica 2d, 1260 Ljubljana - Polje DDV številka SI97703958.
Podjetje omogoča popuste, ugodnosti, storitve in komercialne akcije, navedene v 9. členu (v nadaljevanju »Prednosti«) strankam, ki želijo izkoristiti ugodnosti tega programa na spletni strani www.tezenis.com ali v trgovinah, ki sodelujejo v tem programu zvestobe.
Če želite izkoristiti te ugodnosti, morate postati imetnik kartice zvestobe Tezenis Talent: pridobitev kartice zvestobe Tezenis Talent (v nadaljevanju „kartica“) in njeno uporabo urejajo naslednji pogoji (v nadaljevanju tudi „predpisi“), ki jih mora prejemnik kartice (v nadaljevanju „prejemnik“) natančno prebrati.
Aktivacija kartice na način iz točke 6 spodaj pomeni, da stranka sprejema te Splošne pogoje.
Družba si pridržuje pravico, da kadar koli spremeni te pogoje, tudi delno. Zadevne spremembe bodo začele veljati 10 (deset) zaporednih dni po njihovi objavi v temu namenjenem delu spletne strani www.tezenis.com.
Če imetnik kartice (v nadaljevanju »član«), ne sprejme zadevnih sprememb, lahko prekliče svoje članstvo v programu zvestobe. Ta preklic je možen kadarkoli.
Bo pa morebitna uporaba kartice po začetku veljavnosti teh sprememb pomenila popolno sprejemanje Splošnih pogojev uporabe.
Družba si prav tako pridržuje pravico, da kadar koli začasno ali trajno prekine ta program zvestobe, ne da bi udeleženci lahko temu kakorkoli nasprotovali (pri čemer mora spoštovati pravice, ki so jih udeleženci že pridobili), tako da jih obvesti na svoji spletni strani www.tezenis.com in/ali v trgovinah, ki sodelujejo v programu.
S temi pravili se lahko vedno seznanite na spletni strani www.tezenis.com in na prodajnih mestih, ki sodelujejo v programu zvestobe tako, da o njih povprašate pri prodajalcih.

Kanali sodelovanja
- Vse trgovine »Tezenis«, ne glede na to, ali jih neposredno upravlja podjetje (t. i. »direktne trgovine«) ali so franšizne in jih zato upravljajo druga podjetja (t. i. »franšizne trgovine«), ki s prikazovanjem pripadajočega oglasnega materiala in informacij sodelujejo v programu zvestobe.

2. Država
Program zvestobe bo veljal v Sloveniji.
3. Vrsta / Ime / Namen programa zvestobe “TEZENIS TALENT” / Trajanje
Ta promocija je shema programa zvestobe, ki vključuje zbiranje točk na kartici, imenovani »kartica zvestobe Tezenis Talent«, in ponujanje ekskluzivnih ugodnosti imetnikom te kartice. Cilj sheme je spodbuditi zvestobo strank prek programa zvestobe, ki nudi ugodnosti strankam, ki imajo kartico.
V skladu z določbami, navedenimi v zgornji preambuli, pod točko 6 (»Kako deluje«) in točko 10 (»Prekinitev sheme – Deaktivacija kartice – Razno«), kartica nima roka veljavnosti.
4. Komu je program namenjen?
Stranke, ki so stare vsaj osemnajst let in so imetniki kartice v skladu s spodaj navedenimi postopki registracije in delovanja sheme.
5. Kako se registrirati
Za pridobitev »Statusa začetnik« se »začetno« kartico kupcu izda bodisi v »digitalni« obliki z dostopom do spletne strani www.tezenis.com, prenosom aplikacije »Tezenis« ali neposredno v trgovini.
Stranka lahko ustvari tudi poseben račun na spletnem mestu e-trgovine ali v aplikaciji Tezenis.
Iste poverilnice (prijava in geslo) bodo stranki omogočile dostop do lastne osebne strani na spletnem mestu e-trgovine blagovne znamke in dostop do njenega osebnega profila v aplikaciji Tezenis.
Sistemi registracije strankam, mlajšim od osemnajst let, preprečujejo, da bi se prijavile v program zvestobe. Aktivacija/registracija poteka v skladu z zakonodajo o varovanju zasebnosti.
Kartica je osebna in je ni dovoljeno prenašati na druge osebe. Stranka ne sme aktivirati druge kartice, dokler je ena kartica še veljavna. Kartica je namenjena izključno zasebni uporabi in komercialna uporaba ni dovoljena. Stranke se lahko kadarkoli odjavijo iz programa zvestobe na spletni strani www.tezenis.com ali preko aplikacije Tezenis ali pokličejo službo za pomoč uporabnikom na 080 083 033.
6. Kako deluje
Kartica strankam omogoča, da dosežejo 3 različne STATUSE s pridobivanjem točk zvestobe pri svojih nakupih. Raven ugodnosti je odvisna od doseženega statusa.
6.1 Status začetnika
- Ta status je avtomatično dosežen, ko je "začetna" kartica aktivirana/registrirana.
- Ko stranke s statusom začetnika zberejo 200 točk, se premaknejo na naslednjo raven – »Status slavnih«, kjer jim bodo avtomatično pripisane vse točke, ki presegajo tiste, uporabljene za dosego novega statusa.
- Če stranka s statusom začetnika ne zbere 200 točk v 365 dneh od datuma, ko je pridobila status, ostane na ravni »Status začetnika« njeno stanje doseženih točk pa se izniči.
- Če stranka s statusom začetnika zbere 700 točk še predno pridobi »Status slavnih«, se premakne neposredno v »Status celebrity«, kjer ji bodo avtomatično pripisane vse točke, ki presegajo tiste, uporabljene za dosego novega statusa.
- Stranka pridobi ta status takoj, ko zbere 200 točk in ji bodo takoj pripisane vse točke, ki presegajo točke, uporabljene za spremembo ravni.
- Ko zberejo 500 točk, se stranke z ravni »Status slavnih« premaknejo na raven »Status celebrity«, in jim bodo takoj pripisane vse točke, ki presegajo tiste, uporabljene za dosego novega statusa.
- Eno leto po pridobitvi »Statusa slavnih« in vsako naslednje stranka:
- če si prisluži med 200 in 499 točk, ohrani »Status slavnih« še eno leto, njihovo stanje točk pa se ponastavi na nič.
- če zbere manj kot 200 točk, se njeno stanje točk ponastavi na nič, stranka pa se vrne na raven »Status začetnika«.
- Stranke pridobijo »Status celebrity« takoj, ko si od pridobitve predhodnega »Statusa slavnih« prislužijo 500 točk. Novemu statusu bodo takoj pripisane vse točke, ki so višje od tistih, ki so bile uporabljene za dosego nove ravni.
- Eno leto po tem, ko je stranka dosegla raven »Status celebrity« in vsako leto po tem:
- če si je prislužila vsaj 500 točk, ohrani »Status celebrity« še eno leto in vse točke, ki presegajo tiste, ki so bile uporabljene za ohranitev tega statusa, se ohranijo;
- če zbere manj kot 500 točk, se njeno stanje točk ponastavi na nič in stranka se vrne na raven »Status slavnih«.
Vsaka sprememba statusa, kot tudi vsakršna komunikacija v zvezi z udeležbo v programu zvestobe je nujno potrebna za zagotavljanje storitev, povezanih z njim (na primer potrditev naročnine/odpovedi, spremembe statusa, posebne ponudbe s popusti ali ekskluzivna darila), kakor tudi za delovanje samega programa. S sprejemom teh pravil se stranka strinja, da bo prejemala tovrstna obvestila, ki bodo poslana na naslove, navedene v obrazcu za registracijo v program. Zavrnitev prejemanja takšnih sporočil družbi onemogoča izvajanje programa in zagotavljanje s tem povezanih storitev. Vsaka zavrnitev, izražena med izvajanjem programa, bo povzročila njegovo samodejno prekinitev.
7. Pridobivanje točk
Točke zvestobe se samodejno naložijo na aktivirane kartice ob vsakem nakupu v eni od trgovin Tezenis, ki sodelujejo v programu, ali preko spletnega mesta www.tezenis.com. Vrednost točke se za vsak porabljen evro zaokroži navzdol (npr. 1,99 € = 1 točka). www.tezenis.com.
Da bi se točke, ki izhajajo iz spletnih nakupov ali nakupov v aplikaciji Tezenis, naložile na kartico, morajo stranke predhodno registrirati svojo številko kartice pod svoj račun. Številko kartice je potrebno vnesti samo enkrat, sistem pa jo bo shranil za naslednje nakupe.
Za pridobitev točk se mora stranka pred izdajo računa identificirati s predložitvijo svoje digitalne kartice ali s svojim priimkom in imenom ali elektronskim naslovom/telefonsko številko, ki so jo uporabili za aktivacijo kartice. V primeru spletnih nakupov morajo stranke dostopati do spletne strani ali aplikacije z vnosom svojih podatkov.
Če imetnik kartice ne zagotovi identifikacije na zgoraj naveden način, se točke ne bodo zbirale in jih naknadno ne bo mogoče pripisati.
Stranke lahko kadar koli preverijo svoje stanje točk tako, da to zahtevajo v kateri koli trgovini Tezenis, ki sodeluje v programu, ali na spletnem mestu www.tezenis.com ali svojem profilu v aplikaciji Tezenis. Točke bo sistem dnevno pripisoval in beležil; v primeru tehničnih težav jih je mogoče naložiti v obdobju največ 15 dni.
Za vrnjene artikle bodo točke bremenjene po enakih merilih kot za dobropis.
Pri izdaji »Darilne kartice Tezenis« bodo pridobljene točke pripisane kupcu kartice. Naknadni nakupi, ki so delno/v celoti plačani z darilno kartico, torej ne bodo ustvarili točk za del nakupa, plačanega z darilno kartico.
Lahko se bodo izvajale akcije podvojitve ali potrojitve točk, za kar bo pripravljena ustrezna reklama.
Kartica na noben način ne predstavlja plačilne kartice; na njej nabranih točk ni mogoče prenesti ali pretvoriti v denar ali izdelke.
8.a Zbiranje točk in čezmejne ugodnosti
Kupec, ki ima kartico, lahko zbira točke za vsak nakup, opravljen v eni izmed spodaj navedenih držav (v primeru spletnega nakupa mora imeti kupec naslov za dostavo obvezno v državi, v kateri je opravil spletno naročilo).
Tako pridobljene točke bodo omogočale doseganje statusa in koriščenje ugodnosti v skladu s temi Splošnimi pogoji uporabe, ki veljajo za slovenski trg.
Točke zvestobe bodo naložene na kartico kupca po pretvorbi, prikazani v spodnji tabeli.

Nadaljnja prednost, ki jo imajo imetniki kartice in kupujejo na prodajnih mestih v zgoraj navedenih državah, so morebitni popusti, ki jih posamezna država ob nakupu priznava za posamezni status imetnika.
9. Prednosti
Stranke, ki imajo kartico Tezenis Card, lahko izkoristijo številne popuste, promocijske akcije, nagrade in posebne pobude, ki se bodo občasno ustrezno oglaševale in sporočale.
Stranke lahko izkoristijo posebne ugodnosti le ob predložitvi kartice.
Trenutno so določeni naslednji popusti:
- Brezplačna dostava in vračila pri nakupih v e-trgovini za vse imetnike statusa.
- Za status začetnika: za vsakih 100 zbranih točk, kupon za popust v vrednosti 5 €, veljaven 60 dni od izdaje, pri minimalni porabi 50 € (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Za status slavnih: za vsakih 100 zbranih točk, kupon za popust v vrednosti 8 €, veljaven 60 dni od izdaje, pri minimalni porabi 50 € (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Za status celebrity: za vsakih 100 zbranih točk kupon za popust v vrednosti 10 €, veljaven 60 dni od izdaje, pri minimalni porabi 50 € (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 15-odstotni popust, ko status začetnika preide v status slavnih, ki velja 60 dni od izdaje, pri minimalni porabi 60 evrov (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 20-odstotni popust, ko status začetnika preide v status celebrity, ki velja 60 dni od izdaje, pri minimalni porabi 60 evrov (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 20-odstotni popust, ko status slavnih preide v status celebrity, veljaven 60 dni od izdaje, pri minimalni porabi 60 EUR (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 15-odstotni popust, ko stranka po enem letu obdrži status slavnih, veljaven 60 dni od izdaje, pri minimalni porabi 60 evrov (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 20-odstotni popust, ko stranka po enem letu obdrži status celebrity, veljaven 60 dni od njegove izdaje, pri minimalni porabi 60 evrov (z izjemo izdelkov, ki so že predmet popustov ali promocij).
- Kupon za 15-odstotni popust, ko se stranka s statusom celebrity po enem letu vrne na raven statusa slavnih, ki velja 60 dni od izdaje, z minimalno porabo 60 evrov (z izjemo izdelkov, ki so že predmet popustov ali promocij).
10. Prekinitev sheme - dezaktivacija kartice - razno
Družba si pridržuje pravico, da kadar koli in po lastni presoji spremeni, začasno ustavi ali prekine program zvestobe e Tezenis Talent in z njim povezane storitve.
Kupci bodo o teh spremembah, začasnih ustavitvah ali prekinitvah obveščeni na spletni strani www.tezenis.com oziroma v trgovinah, ki sodelujejo v programu.
Brez poseganja v katero koli drugo pravico, določeno z zakonom, vključno s pravico do povrnitve škode, ima Družba pravico Stranki preklicati pravico do uporabe kartice in jo dezaktivirati v primeru, da se kartica uporablja v nasprotju s pogoji, določenimi v tem dokumentu ali v primeru nezakonite uporabe ali uporabe, ki škoduje podobi »Tezenis« in njegovi blagovni znamki.
Poleg tega si družba pridržuje pravico do dezaktivacije kartice in njene aktivacije/registracije, če se kartica ne uporablja ali če stranka ostane neaktivna več kot 5 let, ob predhodnem obvestilu. Posledica preklica in dezaktivacije je, da stranka ne more več koristiti prednosti in storitev, ki jih ponuja program zvestobe Tezenis.
Družba ni odgovorna za morebitne neposredne ali posredne posledice, ki bi izhajale iz izvajanja programa zvestobe, na katere ne more vplivati.
Družba ni odgovorna za goljufivo, nepravilno ali nezakonito uporabo kartice.
11. Obvestilo o zasebnosti
Družbe skupine Calzedonia skrbijo za zasebnost in varstvo osebnih podatkov. Stranke želimo obvestiti o tem, kako obdelujemo njihove osebne podatke po registraciji v program zvestobe »Tezenis Talent«.

Katere kategorije osebnih podatkov bomo uporabljali?
Zlasti moramo obdelovati osebne podatke, ki so nam bili posredovani ob registraciji (če v obrazcu za registracijo ni vseh podatkov, označenih z zvezdico, postopka registracije ni mogoče dokončati; če poteka registracija tekom nakupa in pri njej sodeluje prodajni pomočnik, je obvezen podatek vaša telefonska številka ali e-poštni naslov; če teh podatkov ne zagotovite, postopka registracije ni mogoče dokončati.) in podatke v zvezi z nakupi na prodajnih mestih Tezenis. Ti podatki vključujejo na primer ceno in vrsto kupljenih izdelkov. Z vašim soglasjem lahko uporabimo tudi druge podatke, ki nam jih prostovoljno posredujete ob registraciji ali informacije o načinu vaše interakcije z nami (v nadaljevanju "podatki").
Natančneje, zbiramo lahko:- neobvezne podatke, predvidene v obrazcu za registracijo; v primeru registracije, opravljene tekom nakupa na posameznem prodajnem mestu, so neobvezni podatki ime, priimek, naslov, poštna številka, država in regija
- informacije, ki jih lahko pridobimo s preučevanjem vaše interakcije, ki jo imate z nami prek e-pošte in novic, prek naših spletnih mest in prek aplikacij, ki jih lahko razvijemo mi ali tretje osebe (za več informacij glejte ustrezne politike zasebnosti);
- informacije, ki jih lahko delite prek družabnih omrežij, na katera ste naročeni.

Za katere namene obdelujemo osebne podatke in na kakšni pravni podlagi?
Podatke lahko obdelujemo, vključno z elektronskimi sredstvi, za te namene:
1. Upravljanje programa zvestobe »Tezenis Talent«
Vaši podatki se bodo uporabljali za zagotavljanje popustov in drugih ugodnosti, ki so vam na voljo in na splošno za vse povezane pogodbene in administrativne obveznosti. Pravna podlaga obdelave je sklenitev naročniške pogodbe v Programu zvestobe.
2. Personalizirana prodajna pomoč
Zagotavljamo vam prilagojeno storitev na vseh naših prodajnih mestih, kjer je aktiven program zvestobe »Tezenis Talent«. Kjer koli že ste, lahko prejmete pomoč in nasvet naših prodajnih pomočnikov (npr. o velikosti, barvi ali vzorcu Tezenis) o izdelkih, kupljenih v preteklih 24 mesecih na katerem koli prodajnem mestu Tezenis ali na spletu. Upoštevaje, da je Tezenis globalna blagovna znamka, nam takšna uporaba vaših podatkov, ki temelji na našem legitimnem interesu, omogoča izboljšanje kakovosti naših storitev na prodajnih mestih in zagotavljanje doslednih storitev našim strankam, ki so se pridružile programu zvestobe »Tezenis Talent« v vseh naših trgovinah. V vsakem primeru, če tovrstnih storitev ne želite prejemati, zadošča, da ob registraciji ali pozneje zahtevate, da se vaši podatki ne uporabljajo v ta namen.

Včlanitev v program zvestobe ""Tezenis Talent"" nikakor ni pogojena s podajo soglasja za prejemanje naših tržnih sporočil.
4. Oblikovanje profilov
S soglasjem strank pošiljanje prilagojenih komercialnih sporočil na podlagi profila članov ter nakupovalnih in iskalnih navad ter za razvoj izdelkov in storitev v skladu s preferencami naših strank. Včlanitev v program zvestobe “Tezenis Talent” nikakor ni pogojena s podajo soglasja za profiliranje.
Za boljše razumevanje okusa in zanimanja naših strank za naše izdelke in komuniciranje, lahko – tudi z uporabo avtomatiziranih sistemov – preučimo podatke, pridobljene ob registraciji v program zvestobe “Tezenis Talent”, nakupe, opravljene na naših prodajnih mestih Tezenis v zadnjih 12 mesecih, zanimanje za naša sporočila in novice, ki jih pošiljamo, obisk naših spletnih mest, uporabo naših aplikacij, ki jih lahko razvijemo mi ali tretje osebe in zanimanje za naše družbene kanale, npr. Facebook (za več informacij si oglejte ustrezne politike zasebnosti).
Nazadnje lahko obogatimo profil članov s statističnimi podatki, ki jih lahko zakonito pridobimo iz drugih virov: na primer v zvezi območjem stalnega prebivališča strank (kot so demografski podatki, geo-referenčni podatki itd.) ali v zvezi z elektronskimi orodji, ki jih stranke uporabljajo za interakcijo z nami. V vsakem primeru je dejavnost oblikovanja profilov namenjena boljši prilagoditvi naših storitev in nima nobenega pravnega ali drugega pomembnega vpliva na naše stranke.
5. Statistična analiza
Izdelava statističnih poročil in vedenjskih modelov, da bi preučili - v agregatni obliki - učinkovitost komercialnih pobud Tezenis z ekonomskega vidika (npr. uvedba novega izdelka) in obravnavali prihodnje komercialne in promocijske pobude. Zlasti lahko preučimo informacije v zvezi z nakupi naših strank (tudi v povezavi z drugimi blagovnimi znamkami Oniverse), državo izvora, starostjo, spolom, podatke, pridobljene s preučevanjem njihove interakcije, ki jo imajo z nami preko e-pošte, naših spletnih mest in preko aplikacij, ki jih lahko razvijemo mi ali tretje osebe (za več informacij si oglejte ustrezne politike zasebnosti). Ta uporaba podatkov, ki temelji na našem legitimnem interesu, nam omogoča analizo – v psevdonimizirani obliki (torej brez informacij, ki jih je mogoče neposredno pripisati posameznim strankam) – podatkov o strankah, da pridobimo strateške informacije v zvezi z nakupovalnim vedenjem strank, o načinih, na katere stranke komunicirajo z nami prek različnih komunikacijskih kanalov ter o učinkovitosti komercialnih in promocijskih pobud, da bi lahko konkurirali glavnim operaterjem v sektorju.

Kako dolgo hranimo podatke naših strank?
- Za namene »Upravljanje programa zvestobe« in »Personalizirana prodajana pomoč« podatkov ne bomo obdelovali dlje od časa, kot je potrebno za upravljanje udeležbe strank v programu zvestobe »Tezenis Talent«. V vsakem primeru se podatki o nakupih strank in njihovih interakcijah z nami ne bodo obdelovali dlje kot 12 mesecev od datuma njihove pridobitve.
- Za namene »Pošiljanje tržnih sporočil (»Neposredno trženje«)« se bodo podatki hranili, dokler stranke ne prekličejo svojega soglasja;

Komu bomo posredovali podatke naših strank?
Da bi dosegli namene, za katere uporabljamo podatke, jih moramo posredovati naslednjim kategorijam subjektov:

Kako bo urejen prenos podatkov naših strank v države, ki niso članice EU?
Zbrani osebni podatki se lahko prenesejo izven Evropske unije. V tem primeru bo prenos potekal v skladu z določili Uredbe EU 2016/679 ("GDPR") (podatki bodo preneseni šele po podpisu Standardnih pogodbenih klavzul, ki jih je odobrila Komisija EU s sklepom 2021/ 914 / EU oziroma v države, ki lahko zagotovijo ustrezno raven varstva osebnih podatkov in s tem prejemnikom odločbe o ustreznosti, ki jo je sprejela Komisija EU).

Kakšne so pravice, ki jih lahko uveljavljajo člani v programu zvestobe kot subjekti, na katere se nanašajo pridobljeni osebni podatki?
Člani programa zvestobe »Tezenis Talent« lahko kot posamezniki, na katere se nanašajo osebni podatki, pravice, ki jim jih glede osebnih podatkov podeljuje GDPR, uveljavljajo tako, da pišejo na privacy@oniverse.it Zavezujemo se, da bomo na zahtevo odgovorili v najkrajšem možnem času, v vsakem primeru pa najkasneje v tridesetih dneh od prejema zahteve. V nekaterih primerih bomo zahtevali kopijo identifikacijskega dokumenta, če bo v zvezi z zahtevo potrebno preveriti identiteto prosilca. Posameznik, na katerega se nanašajo osebni podatki, lahko uveljavlja zlasti naslednje pravice:

Pravica zahtevati popravek ali integracijo podatkov;
Pravico zahtevati izbris osebnih podatkov,
če ti niso več potrebni za namene, za katere so bili pridobljeni, ali če nismo več pooblaščeni za njihovo obdelavo;
Pravica do omejitve obdelave osebnih podatkov
v naslednjih primerih: i) Posameznik, na katerega se nanašajo osebni podatki, je oporekal točnosti osebnih podatkov in sicer lahko zahteva omejitev obdelave za obdobje, ki je potrebno za preverjanje točnosti podatkov; ii) nismo več pooblaščeni za obdelavo podatkov in namesto izbrisa lahko posameznik od nas zahteva omejitev njihove uporabe; iii) če so osebni podatki, ki jih imamo, kljub temu, da niso več potrebni za namene, za katere so bili pridobljeni, potrebni, da posameznik, na katerega se nanašajo, ugotovi, uveljavlja ali brani pravico na sodišču;

tj. pravica posameznika do prejema osebnih podatkov, ki se nanašajo nanj, v strukturiranem formatu, ki se običajno uporablja in je strojno berljiv, kot tudi pravica zahtevati, da se ti podatki posredujejo drugemu upravljavcu podatkov;

za obdelavo na podlagi le-tega;
Pravica kadar koli nasprotovati
obdelavi osebnih podatkov na podlagi našega legitimnega interesa. Posameznik, na katerega se nanašajo osebni podatki, ima tudi pravico, da vloži pritožbo pri pristojnem nadzornem organu za varstvo podatkov, če meni, da je obdelava v nasprotju z določbami veljavne zakonodaje.

Člani programa zvestobe lahko kadar koli preverijo, spremenijo ali prekličejo dano soglasje v zvezi z nameni »Pošiljanje tržnih sporočil (»Neposredno trženje«)« in »Oblikovanje profilov« (vključno z izjavo, da ne želijo prejemati komercialnih informacij po e-pošti in/ali besedilnih sporočilih) in/ali zahtevajo, da se njihovi podatki ne uporabljajo za namen »personalizirana prodajna pomoč«. Terms and conditions of the “Tezenis Talent” promotion
The “TEZENIS TALENT” loyalty program (hereinafter referred to the “Loyalty
program”) is a program proposed by the proposed by the company Verudela d.o.o. (hereinafter referred to “the Company”) with registered office in Anžurjeva ulica 2d, 1260 Ljubljana - Polje VAT number SI97703958.
The company proposes discounts, benefits, services, and commercial actions listed at
article 9 (hereinafter referred to the “Advantages”) to the customers who want to profit
from this program on the website www.tezenis.com
or
in the stores participating in the
loyalty program.
To take advantage of these benefits you must be a Tezenis Talent loyalty card holder: the following terms and conditions (hereinafter also “Conditions”) govern the issue and use of the Tezenis Talent loyalty card (hereinafter the “Card”), which the “Customer Cardholder” should read carefully.
The activation of the Card, via the methods described in point 6 below, implies
acceptance of these General Conditions by the customer.
The Company reserves the right, at any time, to modify these Conditions, including
partially. The modifications made will become applicable 10 (ten) consecutive days after
their publication in the dedicated section of the website www.tezenis.com.
If the customer holding the Card (hereinafter “the Member”) does not accept these
updates, he will be able to cancel his membership in the Loyalty Program. This
cancellation can be made at any time in accordance with the present.
However, the use of the Card, after the entry into force of these modifications, will
imply full and complete acceptance of the General Conditions of Use.
The Company also reserves the right to suspend this loyalty program, temporarily or
permanently, at any time, without the Customer having any right to complain (subject to
any rights already held by the Customer-Holders at that time being upheld), by notifying
the suspension on its website www.tezenis.com
and/or at stores participating in the program.
These rules can always be consulted at www.tezenis.com and also in
the points of sales
participating in the Loyalty Program by asking the sales assistants.

The Loyalty program will be in force in Slovenia.
4. Type / Name / Purpose of the “TEZENIS TALENT” Loyalty Program / Duration
This promotion is a loyalty scheme that involves collecting points
on a card called “Tezenis Talent Loyalty Card” and offering
exclusive benefits to holders of said card. The aim of the scheme
is to encourage Customer loyalty through a loyalty scheme that
offers benefits to Customers holding the Card.
Subject to the provisions set out under the Preamble above, under
Point 7 (“How it Works”) and Point 10 (“Discontinuation of the
scheme – Card Deactivation – Miscellaneous”), the Card has no
expiry date.
5. Who is it intended for?
Customers who are at least eighteen years old and hold the Card in accordance with the below conditions relating to scheme registration and operation.
6. How to register
To earn “Beginner Status”, the “blank” card may be issued to the
Customer in “digital” form by accessing the website www.tezenis.com
or downloading the “Tezenis” application or directly in shop.
To register with the Tezenis Loyalty Programme, Customers shall
create a special account on the ecommerce site or on the Tezenis
application.
The same credentials (login and password) will enable Customers to
access both their own personal page on the brand’s ecommerce site,
and to access to their personal profile on the Tezenis application.
The registration systems shall prevent Customers aged under
eighteen from signing up to the loyalty scheme. Activation /
registration shall take place in accordance with privacy
legislation.
The Card is personal and may not be transferred to others. Each
Customer may not activate other cards while one card is still
valid.
The Card is for private use only and commercial use is not
permitted.
Customers are free to unsubscribe from the loyalty scheme at any
time, by accessing the website www.tezenis.com or
through the Tezenis application or by contacting customer care
on 080 083 033.
7. How it works
The Card allows customers to reach 3 different STATUSES by earning loyalty points on their purchases. Customers will receive an increasing level of benefits in accordance with their Status.
7.1. Beginner Status
- This is immediately acquired when the “blank” card is activated/registered.
- When “Beginner Status” customers earn 200 points they move to the following level – “Famous Status”, which will be immediately credited with any points in excess of those used to reach the new status.
- If a “Beginner Status” Customer does not earn 200 points within 365 days of the date they acquire the status, they remain at the “Beginner Status” level and their points balance shall be cancelled.
- If a “Beginner Status” customer earns 700 points before they have acquired the “Famous Status”, they move directly to “Celebrity Status”, which will be immediately credited with any points more than those used to reach the new status.
- Customers acquire this status as soon as they have earned 200 points. The new status which will be immediately credited with any points more than those used to change level.
- Once they earn 500 points, “Famous status” Customers move to the “Celebrity Status” level which will be immediately credited with any points more than those used to reach the new status.
- A year after acquiring the “Famous Status” level, and every year after that, the
Customer:
if they have earned between 200 and 499 points, maintains “Famous Status" level for another year and their points balance will be reset to zero.
if they have earned less than 200 points, their points balance will be reset to zero and they will return to the “Beginner Status” level.
- Customers acquire “Celebrity Status” as soon as they have earned 500 points since the previous “Famous Status”. The new status will be immediately credited with any points more than those used to move level.
- A year after reaching the “Celebrity Status” level, and every year after that, the
Customer:
- if they have earned at least 500 points, maintains “Celebrity Status" level for another year and any points more than those used to keep this status shall be maintained;
- if they have earned less than 500 points, their points balance will be reset to zero and they will return to the “Famous Status” level.
Each change of status, as well as all communications concerning participation in the loyalty scheme, which are strictly indispensable for providing the services connected to it (for example, confirmation of subscription/cancellation, changes in status, special discount offers or exclusive gifts) are necessary for the operation of the scheme itself. Therefore, by accepting these rules, the Customer agrees to receive said communications, which will be sent to the addresses given on the scheme registration form. Refusal to receive said communications shall prevent the Company from implementing the scheme and providing the services associated with it. Any refusal expressed during the scheme shall result in an automatic interruption of the scheme.
8. Earning points
Loyalty points shall be automatically loaded onto activated Cards when each purchase
is made at one of the “Tezenis” stores which take part in the promotion or via the
e-commerce site www.tezenis.com. One point
will be given for each euro spent, rounded down (e.g., € 1.99 = 1 point).
In order to have the points arising from the e-commerce or the Tezenis application
purchases credited to the Card, Customers must previously register their Card number
under their account. The insertion of the Card number shall be done only once and,
for subsequent purchases the system will automatically remember it.
To be entitled to points, Customers must identify themselves before the receipt is
issued by presenting their digital Card or by giving their surname and name or the
email address/telephone number used for card activation. In cases of online
purchases, Customers must access the website or the app by entering their details.
Should the Cardholder fail to provide identification in the manner specified above,
then points will not be earned, and it will not be possible to have them credited
subsequently.
Customers may check their points balance at any time by requesting it at any
“Tezenis” stores participating in the scheme or by consulting the website
www.tezenis.com or their profile on the
Tezenis
application. Points will be credited
and recorded daily by the system; in the event of technical problems, they may be
credited within a longer period of a maximum of 15 days.
Returned items will result in points being debited according to the same criteria
used for crediting points.
Issuance of a “Tezenis Gift Card” will result in a credit of the corresponding
number of points. Subsequent purchases paid partially/entirely with a Gift Card will
not, therefore, earn any points for the part of the purchase paid for using the Gift
Card.
Promotions involving double or triple points may be organised and these will be
advertised accordingly.
The Card is in not a method of payment; the points credited cannot be transferred or
converted into cash or goods.
8.a Earning point and cross-country benefits
The Member holding a Card may accumulate points for any purchase made in one of the countries listed below (in the event of an online purchase, the Member must necessarily have a delivery address in the country in which the online order is made).
The points collected in the above manner will allow points to be accumulated in order to achieve a status and to use the Benefits in accordance with these General Conditions of Use applicable to the Lithuanian market.
The loyalty points will be credited on the Client’s Card subject to the table below.

9. Benefits
Customers holding the Tezenis Card can benefit from numerous discounts,
promotions, prizes, and special initiatives, which will be suitably
advertised and communicated as the need arises.
Customers may benefit from the special advantages only by presenting their
Card.
The following discounts are defined as of now:
- Free shipping and returns on e-commerce purchases for all Status holders.
- For Beginner Status: every 100 points earned, € 5 discount coupon, valid for 60 days of its issue, on a minimum spend of 50 euro (with the exclusion of items already subject to discounts or promotions).
- For Famous Status: every 100 points earned, € 8 discount coupon, valid for 60 days of its issue, on a minimum spend of 50 euro (with the exclusion of items already subject to discounts or promotions).
- For Celebrity Status: every 100 points earned, € 10 discount coupon, valid for 60 days of its issue, on a minimum spend of 50 euro (with the exclusion of items already subject to discounts or promotions).
- 15% discount on all purchases when the Beginner Status acquire the Famous Status, valid for 60 days of its issue, on a minimum spend of 60 euro (with the exclusion of items already subject to discounts or promotions).
- 20% discount on all purchases when the Beginner Status acquire the Celebrity Status, valid for 60 days of its issue, on a minimum spend of 60 euro (with the exclusion of items already subject to discounts or promotions).
- 20% discount on all purchases when the Famous Status acquire the Celebrity Status, valid for 60 days of its issue, on a minimum spend of 60 euro (with the exclusion of items already subject to discounts or promotions).
- For Beginner Status: double points for purchases done in the period between 7 days before the birthday of the loyalty program member and 7 days after the birthday of the loyalty program member
- For Famous Status: gift of a slip or boxer (in store or online) connected to a purchase done in the period between 7 days before the birthday of the loyalty program member and 7 days after the birthday of the loyalty program member.
- For Celebrity Status: gift of a slip or boxer (in store or online) connected to a purchase done in the period between 7 days before the birthday of the loyalty program member and 7 days after the birthday of the loyalty program member.
Moreover, there will be special advantages for those Customers who will use the Tezenis application (for example, extra points, welcome contest, special challenge, etc). These special advantages will be communicated from time to time inside the Tezenis application.
10. Discontinuation of the scheme - card deactivation – miscellaneous
The Company reserves the right to amend, suspend or discontinue the Calzedonia loyalty scheme and related services at any time at its own discretion. Customers shall be informed of these changes, suspensions interruptions on the www.tezenis.com website or at the stores participating in the scheme. Without prejudice to any other right established under law, including the right to compensation for damages, the Company shall be entitled to revoke Customer's right to use the Card and deactivate it in the event that the Card is used in breach of these Conditions or in the event of unlawful use or use that is harmful to the image of “Tezenis" and its brand. Furthermore, subject to giving notice, the Company reserves the right to deactivate the Card and the associated activation/registration if the Card is not used, or the Customer remains inactive for a period exceeding 5 years. Revocation and deactivation shall result in the Customer no longer being able to benefit from the advantages and services offered by the Tezenis loyalty scheme. The Company is not responsible for any direct or indirect consequences related to problems with the loyalty scheme for reasons that are beyond its control. The Company is not responsible for any fraudulent, improper, or incorrect use of the Card.
11. Privacy Notice
The Calzedonia Group companies care about privacy and the protection of personal data. We hereby wish to inform customers about how we process their personal data following the registration to the “Tezenis Talent” Loyalty Program.

Which categories of
personal data will we use?
In particular, we need to process the personal data provided to us at the time of registration (failure to provide the data marked with an asterisk involves the inability to complete the registration process, in case of registration carried out in each point of sale with the support of the sales assistants, the phone number or email address are mandatory data. Failure to provide these data involves the inability to complete the registration process) and the data relating to purchases made at points of sale Tezenis. These data include, for example, the price and type of products purchased. With customers’ consent, we may also use other information that they freely provide to us at the time of registration or concerning the way they interact with us (hereinafter, collectively, the "Data").
More precisely, we could collect:- optional information requested through the registration form or, in case of registration carried out in each point of sale name, surname, address ZIP code, country and province are optional information;
- the information that we may acquire by examining customers’ interaction with us, through email and newsletters, through our Internet sites and through the Apps that may be developed by us or by third parties (for more information, please consult the relevant privacy policies);
- information that customers may share through the social networks to which they subscribe.

do process Personal Data and on what legal grounds?
We may process Data, including by electronic means for these purposes:
1. Loyalty Program Management
Management of participation to the “Tezenis Talent” Loyalty Program. The Data will be used to provide the discounts and benefits provided for those enrolled in the program and, more generally, for all related contractual and administrative obligations. The legal basis of the processing is the execution of the contract of subscription in the Loyalty Program.
2. Personalized assisted sale
Provision of a personalized assisted sales service dedicated to members of the Loyalty Program who will be able to take advantage of the help and advice of our sales assistants in all our points of sale where the “Tezenis Talent” Loyalty Program is active. Wherever customers are, they could receive the help and advice of our sales assistants, with information (e.g. for Tezenis size, color or pattern) on items purchased in the previous 12 months at any point of sale Tezenis or even online. Provided that Tezenis is a global brand, such use of Data, based on our legitimate interest, allows us to improve the quality of our services at the point of sale and to ensure a consistent service to our customers who have joined the “Tezenis Talent” Loyalty Program in all our stores. In any case, if customers do not wish to receive this assistance, it is sufficient that they, at the time of registration or even at a later time, ask their Data not be used for this purpose.
3. Sending of commercial communications (“Direct Marketing”)
With our customer’s consent, sending of commercial communications through the traditional paper mail service, e-mail, SMS, landline and mobile phone, carrying out market research and surveying the degree of satisfaction regarding products relating to all the brands of the Calzedonia Group (Calzedonia, Intimissimi, Atelier Emé, Tezenis, Falconeri and Signorvino). Subscription to the “Tezenis Talent" Loyalty Program is in no way conditional on the release of consent to receive our commercial communications.
4. Profiling
With our customer’s consent, sending of personalized commercial communications based on subscribers’ profile and purchasing and browsing habits as well as to develop products and services consistent with the preferences of our customers. Subscription to the “Tezenis Talent” Loyalty Program is in no way conditional on the release of consent to profiling.
In particular, in order to better understand our customers’ tastes and interest in our products and communications, we may examine - also through the use of automated systems – the information provided at the time of the registration to the “Tezenis Talent” Loyalty Program, the purchases made at our Tezenis points of sale in the last 12 months, the interest in our communications and newsletters, the attendance of our websites, the use of our Apps that may be developed by us or third parties, and the interest in our social channels, e.g. Facebook, (for more information, please consult the respective privacy notices).
Finally, we may enrich the subscribers’ profile with statistical information that we may lawfully acquire from other sources: for example, in relation to their area of residence (such as demographic information, geo-referencing data, etc.) or to the electronic tools that they use to interact with us. In any case, this profiling activity is aimed at better personalizing our services and does not have any legal or other significant effect on our customers.
5. Statistical Analysis
Creation of statistical reports and behavioral models in order to examine - in aggregate form - the effectiveness from an economic point of view of the commercial initiatives (e.g. launch of a new product) of Tezenis and to address future commercial and promotional initiatives. In particular, we may examine information relating to our costumers’ purchases (also in relation with the other brands of Calzedonia Group), country of origin, age, gender, information obtained by examining their interaction with us, through e-mails, our websites and through the Apps that may be developed by us or by third parties (for more information, please consult the respective privacy notices). This use of Data, based on our legitimate interest, allows us to analyze - in pseudonymized form (therefore without information directly attributable to individual customers) - customer data to obtain strategic information relating to customer purchasing behavior, the ways in which customers interact with the company through the various communication channels and the effectiveness of commercial and promotional initiatives, to be able to compete with the main operators in the sector.

How long do we store
our customers’ Data for?
- For the purposes named “Loyalty Program Management” and “Personalized assisted sale” Data will not be processed for longer than the time required to manage the participation to the “Tezenis Talent” Loyalty Program. In any case, information about purchases and the interactions with us will not be processed for longer than 12 months from the date of collection.
- For the purpose named “Sending of commercial communications (“Direct Marketing”)” Data will be Kept until customers revoke their consent;
- For the purpose named “Profiling” data relating to the interactions with us will be kept for 12 months from the date of collection; the information relating to the purchases will, on the other hand, be kept for 3 years starting from the date of each purchase.
- For the purpose named “Statistical Analysis” data relating to purchases will be kept - in pseudonymized form - for a period of five years. The other personal data will be kept - in pseudonymized form - for a period of two years.

Which are the Data Controllers?
The Data Controllers for the purposes named “Loyalty Program Management” and “Personalized assisted sale” are Calzedonia S.p.A. and Verudela d.o.o.. Calzedonia S.p.A. and Verudela d.o.o. act as Joint Controllers since they together define the means and purposes of processing. The Data Controller for the purposes named “Sending of commercial communications (“Direct Marketing”)”, “Profiling” and “Statistical Analysis” is Calzedonia S.p.A.

To whom will we
communicate our customers’ Data?
To achieve the purposes for which we use Data, we need to communicate them to these categories of subjects:
Calzedonia S.p.A. and Sunshine Baltics Lithuania UAB, in charge with the management of the Loyalty Program;
Employees of companies which, based on a commercial franchising relationship, manage “Tezenis” points of sale;
Companies that manage the “Tezenis” points of sale in the various countries where the “Tezenis Talent” Loyalty Program is active.
Calzedonia S.p.A. suppliers (e.g. service providers and IT platforms, consultants): these subjects are appointed as Data Processors by Calzedonia S.p.A., through the signing of a specific contract. -
How will the transfer
of our customer’s Data to non-EU countries be regulated?
Personal data collected may be transferred outside the European Union. In this case, the transfer will take place in compliance with the provisions of EU Regulation 2016/679 ("GDPR") (in particular, the data will be transferred only after signing the Standard Contractual Clauses approved by the EU Commission with decision 2021/914 / EU or to countries able to guarantee an adequate level of protection of personal data and therefore recipients of an Adequacy Decision adopted by the EU Commission).

What are the rights the
subscribers in the Loyalty Program can exercise as Data Subjects?
The “Tezenis Talent” Loyalty Program subscribers, as Data Subjects, can exercise the rights that the GDPR grants to them over their personal data by writing to privacy@oniverse.it We undertake to respond to the request as soon as possible and in any case no later than thirty days from receipt of the report. In some cases, we will ask for a copy of an identification document if, in connection with the request, it becomes necessary to verify the identity of the applicant. In particular, the Data Subject can exercise the following rights:
Right of access
i.e., the right to know if a processing of personal data concerning her/him is in progress and, if confirmed, to obtain a copy of such data and be informed about the origin of the data, the categories of personal data processed, the recipients of the data, the purposes of the processing, the existence of an automated decision-making process (including profiling), the data retention period, the rights provided for by the applicable law;
Right to request the correction or integration of the data;
Right to request the deletion of personal data
if such data are no longer necessary for the purposes for which they were collected, or if we are no longer authorized to process them;
Right to obtain the limitation
of the processing of personal data in the following cases: i) the Data Subject has contested the accuracy of the personal data. She/He can request a processing limitation for the period necessary to verify the accuracy of the data; ii) we are no longer authorized to process the data, and instead of deleting them, it is possible to ask us to limit their use; iii) if the personal data in our possession, despite being no longer necessary for the purposes for which they were collected, are necessary for the Data Subject to ascertain, exercise or defend a right in court;
Right to data portability
i.e., the right to receive personal data concerning him/her in a structured format, commonly used and readable by an automatic device, as well as the right to request for such data to be transmitted to another Data Controller;
Right to revoke the consent
for the processing based on it;
Right to oppose
at any moment to the processing of personal data based on our legitimate interest. The Data Subject also has the right to lodge a complaint with the competent data protection supervisory authority if she/he believes that the processing conflicts with the provisions of the applicable laws.

At any time, subscribers in the Loyalty Program may check, modify or revoke their consent in relation to the purposes named “Sending of commercial communications (“Direct Marketing”)” and “Profiling” (including by declaring that they do not wish to receive commercial information by email and/or text messages) and/or request that their Data not be used for the purpose named “Personalized assisted sale”. Regarding the registration carried out by website, subscribers in the Loyalty Program can change their preferences:
